TERMS AND CONDITIONS FOR BOOKING AND STAY – LUXMARE
Welcome to Luxmare. The following Terms and Conditions govern the booking, use, accommodation, and short-term stay at our vacation property located in the city of Cartagena de Indias, Colombia. By making a reservation through our website https://luxmareph.com/, digital channels, authorized booking platforms, or directly, you (hereinafter the “Primary Guest”) and your companions expressly accept, without reservation or limitation, compliance with these policies.
1. TOURISM REGISTRATION AND LEGAL FRAMEWORK
In strict compliance with Colombian legislation (Law 300 of 1996, Law 2068 of 2020, and regulatory decrees), Luxmare operates legally as a Tourism Service Provider under the vacation rental category.
Guest Registration: It is an unavoidable legal obligation for the Primary Guest and all accompanying companions to fully identify themselves before or at the time of entry to the property (Check-in) by presenting a valid government-issued ID (National ID Card for Colombian citizens or a valid Passport for international visitors).
Protection of Minors: In strict compliance with Law 679 of 2001 and Law 1336 of 2009 regarding the prevention of commercial sexual exploitation of children and adolescents, the entry or lodging of minors will not be permitted unless they are accompanied by their parents or a legal guardian duly accredited by a birth certificate or an officially notarized authorization.
2. RESERVATIONS, PAYMENTS, AND RATES
Maximum Capacity: Each reservation specifies a maximum number of guests permitted on the property. Under no circumstances will the occupancy of more people than those declared in the booking confirmation be allowed.
Currency and Taxes: Rates displayed on the website are expressed in US Dollars (USD) or Colombian Pesos (COP) depending on the configuration. Guests residing in Colombia are subject to lodging VAT according to current tax regulations; foreign guests who meet the legal migration requirements (PIP stamp or equivalent) may be exempt from VAT according to national law.
Booking Guarantee: A reservation will be considered formalized only when Luxmare receives and confirms the payment of the stipulated percentage (which may vary between 50% and 100% of the total stay depending on the season). The remaining balance must be settled according to the timelines provided during the booking process.
3. CANCELLATION, MODIFICATION, AND NO-SHOW POLICIES
Cancellation policies vary according to the season (High, Mid, or Low) and will be explicitly detailed in your booking confirmation:
Advance Cancellations: Cancellations made outside of the penalty periods will entitle the guest to a refund or a travel credit (as applicable), deducting any bank or payment gateway fees generated by the transaction.
Late Cancellations: Cancellations made within the penalty period or requests for early departure will not be eligible for a refund.
No-Show: If the guest does not arrive on the scheduled check-in date without prior documented notice of force majeure, the reservation will be automatically canceled, and 100% of the amount paid will be retained as a penalty.
4. CHECK-IN AND CHECK-OUT TIMES
Check-in: From 3:00 PM. Requests for early entry (Early Check-in) are subject to prior availability of the property and may incur additional charges.
Check-out: Until 11:00 AM. It is essential to respect this schedule to allow for rigorous cleaning and sanitization of the property for the next guests. Unauthorized late departures (Late Check-out) will generate a penalty fee equivalent to a half-day or a full-day rate fraction.
5. COMMUNITY RULES, USE, AND CONDUCT
To ensure community order and respect the local environment of Cartagena, guests strictly agree to abide by the following rules within the property:
Parties and Events: The organization of parties, massive events, or gatherings that exceed the maximum capacity of the property, generate loud noises, or disturb the peace of the neighbors is strictly prohibited.
Noise Levels: Community quiet hours must be respected. The use of sound systems or loud music is prohibited, especially between 10:00 PM and 8:00 AM.
Non-Smoking Policy: Luxmare is a smoke-free space. Smoking (traditional cigarettes, cigars, vapes, or electronic cigarettes) is strictly prohibited inside the indoor areas of the property. Smoking in restricted areas will result in a financial penalty intended for deep cleaning and deodorization of the premises.
Prohibited Substances: The entry, consumption, or distribution of illicit drugs or psychotropic substances within the property is strictly forbidden. Non-compliance with this rule will result in the immediate termination of the stay without a refund and a report to the police authorities.
Pets: The entry of pets is subject to the specific policy of the property declared on the website. If permitted, the guest is fully responsible for their behavior, hygiene, and any material damage they may cause.
6. SECURITY DEPOSIT, DAMAGES, AND LIABILITY
Security Deposit: Luxmare may require a security deposit in cash or via a credit card hold prior to check-in. This deposit will be fully refunded/released within 3 to 5 business days following check-out, after verifying that the property, its furniture, linens, and electronic equipment are in the same condition in which they were delivered.
Liability for Damages: The Primary Guest assumes joint financial responsibility for any damage, breakage, loss, irreparable stains on linens, or abnormal deterioration caused to the infrastructure or property of Luxmare by their own negligence or that of their companions. The cost of repair or replacement will be assessed by the administration and deducted from the deposit, or billed directly if it exceeds the deposit value.
7. LIMITATION OF LIABILITY
Valuables: Luxmare is not responsible for the loss, misplacement, or theft of cash, jewelry, electronic devices, or valuables left in the common areas or rooms of the property. Guests are urged to use the provided security measures (such as safety deposit boxes if available) and to properly close all doors and windows when leaving.
Utility Outages: Luxmare is not responsible for fortuitous interruptions, rationing, technical failures, or temporary suspensions of basic public utility services organized by the provider companies in the city of Cartagena (water, electricity, gas, or internet). However, the administration will manage any internal technical contingency within its direct control as quickly as possible.
8. EVICTION FROM THE PROPERTY
Serious or repeated violation of any of the clauses established in these Terms and Conditions (especially regarding over-occupancy, loud noises, unauthorized parties, immoral conduct, or consumption of illegal substances) will authorize the administration of Luxmare to demand the immediate evacuation of the property and the unilateral termination of the lodging service, counting with the support of the National Police if necessary. In this scenario, the guest will forfeit the right to any financial refund.
9. GOVERNING LAW AND JURISDICTION
These Terms and Conditions are governed by and construed in accordance with the laws of the Republic of Colombia. Any dispute, claim, or litigation arising from the interpretation or execution of this document will be submitted in the first instance to a direct conciliation stage and, failing that, before the competent authorities of the city of Cartagena de Indias, Colombia.
